Dunedin FL – We recently saw something positive on short sales with Bank of America. Bank of America recently sent out an email stating that you can no initiate the short sale process without a buyer.

The agent can start the process and get things going before a buyer makes an offer to purchase the property.

This will help to reduce the short sale timeline. All of the documents will be submitted and if the negotiator needs anything else, they can request it earlier in the process.

This also allows Bank of America to contact the owner of the loan earlier. This is important as some loan owners can take a while to respond.

Dunedin Short Sale Help: Another short sale almost killed by lender incompetence


Dunedin FL – We have seen many instances where a short sale that should have been approved was denied. If your short sale realtor doesn’t know what they are doing, then you might get stuck with a promissory note that you don’t deserve.

Here is a good example of this happening. A real estate agent had a short sale with one of the largest lenders in America. The short sale negotiator said that they would not approve the short sale unless the seller came to closing with 50k cash. The sellers said no way.

Fortunately, the agent knew that Fannie Mae owned their loan. The good news for the seller is that Fannie Mae does not ask for promissory notes or pursue deficiencies. (There are a couple exceptions, but they didn’t apply here.) If those are Fannie Mae’s Guidelines, then why would the short sale negotiator require the seller to bring 50k to closing?

Turns out the negotiator was not following Fannie Mae’s Short Sale Guidelines. The agent contacted Fannie Mae directly. Within 72 hours a supervisor called from the short sale department. This time they were singing a different tune.

The sale was approved and the promissory note waived. The seller got to walk away owing zero. Why do things like these happen? Because, in our opinion, there is little oversight over the short sale process. Nothing happens when a short sale gets rejected and sells for less as a bank owned property. No, don’t kid yourself, this happens a lot.

These short sale negotiators develop an adversarial mindset. They probably even get paid bonuses based on how much money they squeeze out of short sale sellers. This causes their ego to get in the way of what is best for the owner of the loan. If you are thinking about short selling your home, make sure your agent knows how to research who the owner of your loan is. That info will allow them to negotiate from a position of power. And it will help you avoid a deficiency or promissory note.

Dunedin Short Sale Question: What Are My Options?


Dunedin FL – The Stop Foreclosure Insitute recently received a question from Denzel.

Here was his question. “I purchased my home in 2007 for 365,000 and put 18,000 down. Today I owe approximately 340000.

The mortgage is with Wells Fargo. No Second. The same size home is being sold by the builder brand new for 240,000 brand new.

I have to move for retirement, and don’t have a job lined up. What are my options. Denzel.”

Here was our answer to Denzel’s Question. I think a short sale would be your best option. Let me explain why.

First, in most cases the bank will forgive you of the upside down debt. Second, it is a clean break that allows you to move on without having to worry about the house anymore.

Many people would consider renting out their house. But, that will only turn your home into a long term burden. You will have to collect rent each month from the tenant and cover the mortgage if they don’t pay.

Besides, managing a rental home from another town is difficult. You won’t know how the tenants are maintaining it. It will be hard to rent the home to someone else after the move.

You will have to come back to town or hire someone else to rent it for you. This just means more expense and hassle for you. Again, which is why I recommend a short sale.

A third option is to simply stop paying on the home and let the bank foreclose. But, you end up with more credit damage versus if you short sold the home. Thinking about a short sale?

Dunedin Short Sales: Questions to ask before hiring a short sale agent


Dunedin FL – The right agent can make the difference between success and failure on your short sale. You risk losing a lot when your agent doesn’t understand short sales. The short sale can be denied and the home foreclosed. Then you have to wait five years to buy another house. Or, the lender may ask you to repay the loss.

Here are the questions I would ask an agent before hiring them.
Question #1: How many short sales have you listed and sold in the past 6 months? This is important because you want an agent who is up to date on all the potential issues. They should understand the short sale process from start to finish.

Question #2: In the past, what lenders have you negotiated short sales with? It is helpful when the agent you are interviewing has already done short sales with your lender. You know that they will already be familiar with your lender’s policies and procedures.

At a minimum, you should look for an agent with experience with Bank of America, Wells Fargo, and Chase. These are the most common short sale lenders.

Question #3: What can you tell me about my lender and how they work? A knowledgeable and experienced agent will usually know the specifics about your lender. They will be able to tell you what to expect in the process. They will know upfront if the lender is likely to ask for a promissory note or deficiency.

Question #4: What is your track record for success and failure on short sales you have handled in the past? Look at the agent’s track record. If they are hard working and diligent, then they will have a strong track record. That is good news for you.

A lot of the people short selling today never had a blemish in their credit. They lived perfect, responsible financial lives. Then the real estate market crashed and left them owing way more than their home was worth.

For years everyone had told them that couldn’t happen. Many of those people also lost their job for the first time in their life. You must remember, you are not alone. We are seeing as many short sales in the upper income brackets as the lower income brackets.

I will not be judgmental when you short sell with me. I deal with people from all walks of life. Some are high income. Others bought less expensive homes. Either way, it doesn’t matter to me. I see a short sale as a smart financial decision.

So I won’t be judging you. Instead, I’ll be congratulating you. Who wants to be burdened with a huge debt for the rest of your life? Not me. And neither should you. Here is why a short sale is a smart financial decision.

Let us say that you are upside down on a house by $100,000. (If you owe less than that, don’t laugh. Many people are upside down by that amount and more.) Repaying $100,000 over 30 years, will cost you $215,000. That is the $100,000 originally owed, along with $115,000 in interest payments.

What if instead of doing that, you put that money towards retirement? You could earn 5% interest on that money. $215,000 at 5% is $10,750 a year. Would that be helpful in retirement? That is one small reason I recommend short sales to my customers. You can get the upside down debt forgiven in a short sale.

How To Ensure Accurate Appraisals And A Successful Dunedin Short Sal


Dunedin FL – The biggest threat to your short sale is a high appraisal. Which is why your agent needs to make sure the appraisal is accurate.

Here is the process your agent needs to follow to ensure an accurate appraisal.

The person doing the appraisal doesn’t understand why the home is selling for a specific sales price. They don’t understand why buyers are only willing to pay X. That is why your agent must explain that to them.

First, your agent should always meet them at the property and bring a detailed Comparable Market Analysis (CMA) with them.

The CMA should include at least 3-5 comparable sold homes, 2-3 comparable homes currently under contact, and 3-5 active competing homes currently on the open market.

They should put together a detailed CMA using the sold comparable sales. They will give that CMA along with the actives and pendings to the person doing the appraisal.

They will ask them what they feel the value of the house is. Then, your agent should show them the MLS history and explain why the house is only selling for X.

The key with the CMA is to use the closest comps available. You can use 1-2 REO comps when a real estate agent is doing the appraisal. Appraisers want the closest geographic comps available.

A real estate agent will use your agent’s comps most of the time. An appraiser won’t do that very often. Thinking about a short sale?

4.) Working with one realtor you can trust will not only establish a friend with useful information, but they will be there after the foreclosure when you’re going to need to know where to turn. They will have options available for you from rental units to get you through this tough spot, to possibly even purchasing a new home. You may be surprised at the options available. Having someone experienced in the business will be a plus no matter which direction you go once you finish the foreclosure process.

5.) Find a realtor in the Dunedin area that truly cares. Yes, we are realtors to make money; it is our job. But we are also human beings and should remember to work with you while making you feel as good as possible with the options you may have. Perhaps this is a dark moment for you and your family but the truth is, if you have a good realtor you should have a good chance at finding a decent home, either as a rental or other possible ways of purchasing it. That’s where an experienced realtor comes in… we know the “other possible ways” out there.

When A Bank Should Accept A Buyer’s Offer To Buy A Dunedin-Palm Harbor-Clearwater Short Sa


Dunedin FL – A bank should accept your short sale when the following rules apply. All banks and servicers have a fiduciary duty to the investor of the loan.

If they own the loan themselves, they have a fiduciary duty to their stockholders. The duty is to get that investor the most money possible.

So, a lender should accept an offer if it will net the most money.

The answer is that it is unlikely that any of that will happen.

Here is how we can assure the negotiator that the offer will net them the most money. Your only job is to prove that to the lender.

Do that by showing them that the property has been on the open market for 60-90 days. It is best to be able to show that the house was easy for buyers to see and other agents to show.

Ask them the following, “The agent selling the home is an experienced agent. The house has been on the market for X number of days. I have lived here the entire time and kept up on the house.

It looks good. We have had 43 showings since it’s been on the market. Out of that, only 3 buyers expressed interest. Out of those 3 buyers, the current buyer is the one willing to pay the most money.

The agent is doing their job marketing the property. With the current foreclosure case status, the home won’t be foreclosed until June or July. When you foreclose on the house, I will move out.

I won’t be keeping the house up anymore. The new listing agent will be working on 20 other homes and won’t be able to do as good of a job as myself. Do you honestly think the home is going to sell for more money at that time?”

Dunedin Short Sales: I’m Sick And Tired And I’m Not Taking It Anymore!


Dunedin FL – We recently received an e-mail from another agent that was having a hard time with a short sale.

“I have been working this short sale file for 4 months. There has been “no movement” no responses from the bank, no closing date.

The Jan. 30th date just continues to trickle closer and closer leaving the sickened buyers more upset and almost at their wits ends.”

Here is what we do when we get frustrated with short sales. We send out press releases and contact the bank’s CEO. If employees are dragging their feet, then you need to apply pressures elsewhere!

We had a short sale with a large national lender. We sent a fax to the CEO and got a response the next day. We are currently running a big press blitz against another lender.

They have dragged their feet on a short sale on a Veteran’s Administration Insured loan. As a result, a US Veteran risks losing his house to foreclosure.

This lender has the right to decide to do a lousy job. But, they also risk alienating themselves from the 27 million veterans in the US.

And we are going to let those veterans know what’s happening. We put together the facts on the story. We are going to fax the story to every single VFW post in the US.

Dunedin FL – The biggest threat to your short sale is a high appraisal. Which is why your agent needs to make sure the appraisal is accurate.

There are a lot of opinions on how to ensure the appraisal is correct and accurate. You need to check and make sure your agent is willing to do the extra work.

I will tell you what happened to an agent that decided it was too much work. This agent decided not to do the extra work. Then, short sales started getting turned down for no reason at all.

This agent thought they were doing everything right. They couldn’t see how they were doing wrong. The buyers were only willing to offer so much and the bank only willing to accept so little.

The buyer’s offers were higher than the property would have sold for after being foreclosed on by the bank. So they kept turning down the buyer’s offers. “We think the house is worth 300k”, they would say.

“But, we think the house is worth 250k”, replied the buyers. The short sales became more and more difficult.

Here is the good news. Now this agent checks to make sure every single appraisal is accurate. Today most of their short sales are being approved.
